Terms of Service

These Terms of Service (the "Terms") govern your use of the ReTouched website and your purchase of any product from it. By browsing the site, creating an account or placing an order, you agree to these Terms. If you do not agree to them, please do not use the site.

1. Who may use the site

You must be at least 18 years old, or the age of majority where you live, to buy from us. By placing an order you confirm that you meet that requirement and that the payment method you are using belongs to you or that you have permission to use it.

2. Your account

You do not need an account to order, but if you create one you are responsible for keeping your login details private and for everything that happens under your account. Tell us promptly if you believe someone else has access to it. We may suspend or close an account that we reasonably believe is being used fraudulently or in breach of these Terms.

3. Products, descriptions and pricing

We try to describe our products accurately, including size, ingredients and directions for use. We do not warrant that every description, image or other detail on the site is complete, current or free of error. Colours and packaging may differ slightly from the photographs shown on your screen.

All prices are shown in US dollars and exclude shipping and any applicable tax, which are calculated at checkout. We may change prices, run promotions, or withdraw a product at any time without notice. If a product is listed at an obviously incorrect price because of a technical or human error, we may cancel the affected order and refund you in full rather than honour that price.

We may limit the quantity of any item sold to one person, household or order, and we may refuse or cancel any order at our discretion.

4. Cosmetic products and what our claims mean

Our products are cosmetics. They are intended to support the appearance of skin. They are not drugs, they are not intended to diagnose, treat, cure or prevent any disease or condition, and nothing on this site should be read as medical advice.

Individual results vary. Information we publish about ingredients, including references to published research, is provided to explain how a formulation is built — not as a promise about what will happen to your skin. If you have a skin condition, a known allergy, or you are pregnant or breastfeeding, speak to a qualified healthcare professional before using a new product. Patch test before first full use, and stop using the product if irritation occurs.

5. Orders, payment and fulfilment

Your order is an offer to buy. A confirmation email acknowledges that we received it; the contract is formed when we dispatch the product. Payment is taken at checkout through our payment providers, and we never store your full card details ourselves.

Some or all of our products are shipped by third-party fulfilment partners, which may be located outside the United States. Delivery estimates are estimates, not guarantees, and can be affected by customs, carrier delays and events outside our control. Risk of loss passes to you on delivery.

6. Shipping, returns and refunds

Shipping costs and delivery windows are shown at checkout. Our returns and refund terms are set out in our Refund Policy, which forms part of these Terms. Where those two documents conflict on a returns question, the Refund Policy governs.

7. Content you submit

If you send us a review, photograph, video, comment or any other material — through the site, by email or on social media — you keep ownership of it, but you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt and display it in connection with our business, including in marketing, without payment to you.

You confirm that anything you submit is your own, that it is accurate, that it does not infringe anyone else's rights, and that it contains nothing unlawful, defamatory, hateful or obscene. We may edit, refuse to publish, or remove submitted content at any time, and we are under no obligation to monitor it.

8. Our intellectual property

The site and everything on it — including our name, logo, wordmark, product names, copy, photography, layout, graphics and code — belongs to us or our licensors and is protected by copyright, trade mark and other laws. You may view and print pages for your own personal, non-commercial use. You may not copy, republish, scrape, resell, frame or create derivative works from any part of the site without our written permission.

9. Things you must not do

You agree not to use the site to break any law; to impersonate another person; to upload viruses or malicious code; to scrape, crawl or harvest data by automated means; to interfere with the security or operation of the site; to attempt to gain unauthorised access to any part of it; or to use it for any purpose other than the one it is provided for.

10. Links to other sites

The site may link to third-party websites or services. We do not control them, we do not endorse them, and we are not responsible for their content, products or privacy practices. Any dealings you have with a third party are between you and them.

11. Disclaimer of warranties

The site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, secure, or free of errors or harmful components.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of your use of the site or any product bought through it. Our total liability for any claim relating to a product or to these Terms will not exceed the amount you paid us for the product giving rise to the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.

13. Indemnity

You agree to indemnify and hold harmless ReTouched, its officers, employees and suppliers from any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the site, or your violation of any law or third-party right.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules, and by applicable federal law of the United States.

15. Disputes and arbitration

Most problems can be sorted out quickly by email, so please contact us first and give us a fair chance to fix things.

If we cannot resolve a dispute informally within 30 days, you and we agree that any dispute arising out of or relating to these Terms or to any product will be resolved by binding individual arbitration administered under the rules of a recognised US arbitration provider, seated in Massachusetts, rather than in court. Either party may still bring an individual claim in small-claims court if it qualifies.

Waiver of class actions

Claims must be brought in your individual capacity. You and we each waive any right to bring or participate in a class, collective, consolidated or representative action. If this waiver is found unenforceable for a particular claim, that claim proceeds in court and the rest of this section still applies.

16. Changes to these Terms

We may update these Terms from time to time. The version published on this page is the one in force. Continuing to use the site after a change means you accept the updated Terms. Changes do not apply retroactively to orders already placed.

17. General

If any part of these Terms is found to be unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver of it. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and us about your use of the site.
